In July, Amazon began to enforce German WEEE, and many sellers have been notified! On January 1, 2023, Amazon, eBay, AliExpress and other platforms will take effect for German WEEE compliance. Amazon especially emphasizes that registration information must be submitted before October, otherwise sellers will be subject to the risk of bans, competition complaints, product removals and even a fine of up to 100,000 euros!

1. WEEE of German EPR

WEEE stands for Waste Electrical and Electronic Equipment, waste electrical and electronic equipment. In order to protect the environment, Germany introduced the ElektroG regulation to regulate the recycling of all electrical and electronic products in Germany.

1. Who is applicable?

Sellers placing electrical and electronic equipment on the German market must be registered with WEEE.

2. The detailed categories of products involved are divided into 6 categories

1) Heat exchangers (such as air conditioners, refrigerators, etc. that use additives or coolants to exchange temperature)

2) Display devices for private households (such as monitors, electronic photo frames and other electronic devices with a screen larger than 100cm²)

3) Lamps/Gas lamps (eg light bulbs)

4) Large electronic equipment (such as massage chairs, leisure sports equipment and other electronic equipment larger than 50cm)

5) Small electrical and electronic equipment (such as watches, headphones, light strings, DVD players, drones and other electronic equipment with a size of less than 50cm)

6) Small IT and telecommunications equipment (such as USB data cables, car GPS navigation equipment and other electronic equipment with information transmission functions)

Domestic cross-border sellers mostly apply to category 5 , but there are exceptions; for example, a power bank with a USB cable needs to be registered in two categories: the power bank belongs to category 5, and the USB cable belongs to category 6.

WEEE and battery method are often confused, and Xiao O focuses on it. Although WEEE and battery method control categories are similar, there are still essential differences between the two:

1) Recycling products are different

WEEE is the Waste Electrical and Electronic Recycling Directive, which only recycles electrical appliances, not batteries.

The battery law is a battery recycling directive, specifically recycling batteries, not electrical appliances.

2) The scope of registration is different

WEEE is aimed at all electrical and electronic equipment in the EU, and all goods related to electrical appliances need to be registered.

The battery law is relatively limited, only for electronic products with batteries.

3. Does the German WEEE label have to be printed? Yes.

WEEE is a trash can with a solid line at the bottom of the fork (this is a whole, and none of them can be leaked during printing~). Note that this signage should be distinguished from the German battery law.

Pay special attention when printing:

1) The height of the black solid line must be greater than 0.3a or 1mm, and the height of the entire logo must not be less than 7mm

2) The line of the icon can be adjusted, such as thickness or smoothness, etc., but the basic appearance of the original icon must be maintained, and the color is recommended to be black

3) The standard WEEE logo must be clearly visible and cannot be easily erased, and must be kept from curling after use. (Tested according to the method developed by EN50419: the WEEE mark should be rubbed with a damp cloth dampened with water for 15 seconds, and then rubbed with a damp cloth dampened with denatured alcohol for 15 seconds)

4) If the product is too small, or other reasons hinder the printing label, it can be printed on the instructions and packaging

4. Failure to comply with German WEEE has the following consequences

1) The cross-border platform will deal with it, directly remove it from the shelves and stop selling in Germany, and if it is serious, the store will be closed;

2) The Federal Environment Agency will impose a fine of up to 100,000 euros;

3) More serious complaints will be reported by competitors or sellers, and corresponding criminal and civil liabilities will be retroactively imposed.

2. Packaging Law of German EPR

In force! Delisting has started! On June 15, Amazon gradually blocked products that did not comply with German packaging laws. On July 1st, sellers on all cross-border platforms such as AliExpress who have not registered the German EPR, cannot display their products in Germany and cannot sell to the country.

1. Who should register?

Every product sold in Germany must have a lot of packaging, so all sellers in Germany must register the German packaging law, and declare the packaging material, type and weight of the pre-sale product , otherwise the product will be banned from sale or even fined up to 200,000 yuan Euro fines. 1) Paper skin

4) Ferrous metals: iron, manganese, chromium, vanadium, titanium

Note: Excludes packaging contaminated with toxic substances, such as pesticide bottles.

The seller will have a packaging law registration number starting with DE after registration, and the product must also be printed with a recycling sign (signage). At present, the German official does not force the printing of the packaging law logo, but the products in the German market basically carry it.

3. How to print?

3. The battery law of German EPR

Germany turned the European Battery Directive /66/EG into national law, called the Battery Act (BattG). Note: From January 1, 2021, BattG has been upgraded to a new battery law, BattG2, which will take effect on January 1, 2022. The new battery law is charged on a calendar year basis, that is, no matter when a seller registers, the expiration date is December 31 of each year. Therefore, sellers who need to register the German battery law should register as soon as possible, and get the certificate early and feel at ease!

The German battery law applies to all types of batteries and accumulators. Therefore, sellers selling batteries/products containing batteries must be registered with the Battery Act.

2. What specific products are to be registered?

1) Types of batteries and accumulators (eg: AAA battery)

2) Products with built-in batteries (eg: mobile phones)

3) Products containing batteries (eg: electric toys with batteries)

3. How to print the recycling logo?

The German battery law recycling mark is as shown below, the seller must label according to the requirements of BattG2, and provide the corresponding capacity indication.

If the battery exceeds the limit for heavy metals mercury, cadmium or lead, the corresponding chemical abbreviation must also be specified next to the label. Usually, if the size of the battery is less than 0.5×0.5 cm, there is no need to print on the battery, but a 1×1 cm battery recycling logo is printed on the packaging.

4. Consequences of sellers not registering with German battery law

1) Delete the ASIN and remove the product link;

2) When the goods arrive in Germany, they are detained by customs;

3) Confiscate all the seller's profits in Germany;

4) Competitors complain, and the products face the whole store being taken off the shelf;

5) The maximum fine is 100,000 euros.

Q1: What should I do after registering for the German EPR?

The first is to print the logo as required, the second is to upload the registration number to various platforms such as Amazon, the third is to report on time, and the fourth is to pay environmental protection fees to the relevant production organizations.
