Every year, unscrupulous peers do things in the peak season, and this year is no exception, and it is especially rampant. Not only maliciously complained about taking the listing off the shelves, but also threatened to extort, and vowed not to give up until they got the money.

According to Jite's observation, there are two main spoof tricks for unscrupulous peers:

① Malicious complaint of copyright infringement

Sellers reported that their well-selling listings were maliciously complained of copyright infringement, and the delisting emails sent by Amazon also contained a strong warning.

Almost all the contact information in the email has words such as "Contact to withdraw the complaint and continue to complain after X hours". After receiving the money, the other party did withdraw the lawsuit as agreed, but will repeat the same trick soon~

Browsing the cross-border forum found that many sellers have encountered this situation. Malicious complaints about copyright infringement are powerful and difficult to appeal, and sellers are unwilling to face them.

how to respond?

There are two common types of malicious copyright infringement complaints. One is to copy the seller's listing to a self-built website or other sites. If the seller can't prove the copyright ownership, or what happens to be an infringing product, it is easy to be pinched.

This kind of spoof takes advantage of Amazon's copyright infringement complaint loophole, and it is hard to prevent. The best way to deal with it is to take precautions before it happens, and save the materials that can prove the ownership of the copyright in advance. If you encounter malicious complaints, you can appeal and restore listings faster and more effectively. for example:

①Save the original image and some creative proofs with time nodes when taking product pictures;

②Establish an independent website for the brand, and upload the listing to the independent website for the record before uploading it to Amazon;

③ Register copyright for original works in time (registration can also be effectively resolved after listing is taken off the shelf);

If you do not save the information in advance, you can choose to submit a DMCA to appeal, but you must confirm that the listing is not infringing before submitting . If it is submitted in the case of infringement, once the other party sues or is determined by Amazon to be misused, it will face the danger of being banned.

② Malicious squatting trademark

Some sellers revealed that they had been extorted nearly 550,000 by trademark hooligans. The reason was that the German trademark of the same name of the accessories sold was squatted. A fast temporary ban was issued in Germany to freeze seller accounts. The other party is aggressive, and the seller can only compromise and spend money to solve it.

Malicious squatting trademarks are generally extortionate money, and the asking price is not low. If they don't give money, they will continue to "press" with various spoof tricks, such as tampering with listing picture information, adding other trademarks to listings and titles, and so on.

how to respond?

① For trademarks that are being applied for and have not been approved for registration, you can file an objection to the Trademark Office as soon as possible.

②For trademarks that have been successfully registered, an application can be made for invalidation or revocation.

③ If the above two methods are not applicable, you can choose to invest in "redemption" of the registered trademark.

But no matter how you do it, it is time-consuming, labor-intensive and expensive, so the best thing to do is to prevent problems before they happen:

①Strengthen trademark testing. If the enterprise/seller has plans to enter the overseas market, they should pay attention to the local trademark application announcement, and file an objection or lawsuit in time if the squatting is found, which will kill the squatting in the cradle.

② Register the trademark as soon as possible. Trademark registration is strictly territorial and is only protected in the place of registration. Domestic registered trademarks are not legally protected overseas. Therefore, sellers need to register overseas trademarks as soon as possible to protect their own interests.

③ Conduct defensive registration . Trademark protection is divided into categories, and defense registration can be carried out for similar or non-similar commodity categories to the trademark, and the trademark layout can be done well to avoid infringement.
