


Goods falling under the Waste Electrical and Electronic Equipment Directive ( WEEE ) will be subject to Extended Producer Responsibility ( EPR ) requirements if sold in Germany. Effective January 1 , 2023 , Amazon will be obligated to suspend non-compliant products listed under the WEEE product category.
Extended Producer Responsibility ( EPR ) is an environmental policy that holds producers accountable for the entire life cycle of the commodities they put on the market, from the beginning of commodity design to the end of the commodity's life cycle (including the collection and disposal of waste materials). According to the provisions of the Extended Producer Responsibility Regulations, responsible entities must reduce the impact of their commodities on the environment throughout the commodity life cycle. And electrical and electronic equipment ( EEE ) is one of the EPR 's commodity classification.
According to German WEEE requirements, you are considered a producer if you meet at least one of the following conditions:
1. You are a manufacturer, i.e. an entity that manufactures goods subject to WEEE in Germany and sells it under your own trade name or brand;
2. You sell WEEE -regulated goods from other manufacturers under your own trade name or brand in Germany or resell them commercially. In this case, the manufacturer will not be considered a producer because your trade name or brand is displayed on the electrical and electronic equipment;
3. For commercial purposes, your first sale in the German market of goods subject to WEEE that does not originate in Germany . This includes the importation of goods subject to WEEE into Germany from overseas ;
4. You supply goods subject to WEEE directly to German end users through online sales , but your company is not located in Germany.
You may also be subject to the same obligations as the producer if you sell (negligence or intentional) WEEE -regulated goods supplied by an unregistered or incorrectly registered producer .
From January 1 , 2023 , Amazon will be legally required to check your compliance with your obligations under the German Waste Electrical and Electronic Equipment Directive ( WEEE ). If you sell goods in Germany that fall under the Electrical and Electronic Equipment Waste Directive, Amazon will collect and verify your WEEE registration number ( WEEE-Reg.-Nr number).
If you are unable to demonstrate to Amazon that you are compliant with WEEE , Amazon will be obliged to suspend your non-compliant listings under the WEEE product category. Therefore, sellers in Germany must pay attention to check whether the relevant products in their stores are compliant as soon as possible.
