Are you doing things again? Let's take a look together!
The latest requirements of Amazon's US site: For products with wireless functions, from March 7, 2022, products without FCC ID certification will be removed from the shelves. Considering the certification cycle, so as not to affect later sales, please prepare for certification in advance. Cycle 3 weeks.
According to the FCC, almost any electronic or electrical product is capable of emitting radio frequency energy, Amazon said.
" Examples of RFD products regulated by the FCC include: Wi-Fi devices, Bluetooth devices, radios, broadcast transmitters, signal boosters, and devices using cellular technology."
Recently, some sellers reported that when their products were exported to the U.S. customs, they were spot-checked by the U.S. market surveillance department and asked them to show the contact information and other information of an authorized U.S. agent.
In addition, sellers have also received notices from e-commerce platforms such as Amazon, requiring sellers to supplement the relevant communication information of authorized agents in the United States before the deadline, otherwise the platform will take corresponding restrictive penalties.
A new round of strict control of Sdoc (US generation) has begun. In addition to the required /FCC-ID and other certificates for imported products from the United States, no US generation will face penalties such as deduction or prosecution!
01. What is FCC?
FCC certification mode for different types of products
Wireless remote control products: certification is required, and the transmitting part needs to get an ID number, which is FCC-ID.
Other electronic products: need to do SDoC and obtain a qualified third-party laboratory report (FCC certification).
02 .FCC certification requirements
For electronic products without FCC, if the goods are sampled for inspection, the customs will determine that they are unqualified and lead to deduction of the goods.
In addition, the FCC certification of Amazon's US station is mandatory for electronic products. If there is no FCC certification, it will not be possible to sell products on the platform.
At the same time, when the U.S. market surveillance department conducts a spot check, it is necessary to provide the name, complete mailing address and telephone number of the authorized agent in the United States.
Unlike the EU representative:
The information of the authorized agent in the United States does not need to be affixed to the product, but needs to be provided directly to the e-commerce platform, or presented when the U.S. market surveillance agency conducts a spot check.
Moreover, the authorized agent in the United States cannot be an individual, but must be an institution or company that operates stably for a long time, and can communicate with the market supervision agency at any time 24 hours a day.
03. Responsibilities of U.S. Authorized Agents
As required by U.S. regulations, any foreign enterprise engaged in the manufacture, preparation, propagation, compounding, or processing of equipment imported into the United States must identify a U.S. Authorized Agent (US Agent) for the enterprise.
The main roles of the U.S. authorized representative:
1. As the authorized representative designated by the manufacturer, responsible for liaising with regulatory agencies in the United States, and assisting in product accident reports, notices, recalls, etc., through its U.S. authorized representative/U.S. authorized agent;
2. Retain the manufacturer's technical documents, and contact the manufacturer, reply and communicate when the regulatory agency raises questions;
/FCC-ID certification materials need to contain the information of the United States Authorized Representative (SDOC): name, address and telephone number, etc.
04. Penalties for No U.S. Authorized Representative
According to U.S. regulations, products imported into the U.S. market require certification such as /FCC-ID and customs clearance. Now the U.S. has begun to strictly control the information of U.S. authorized representatives in the certificate, and certificates without relevant information will not be used. Customs accepts that the seller may face penalties such as deduction or prosecution.
And if the U.S. authorization uploaded by the seller's platform backend does not match the U.S. authorized agent information in the registration application, the U.S. Customs will also conduct random checks on the seller's goods, seize or even limit the store's authority.
05. Note the following:
If you are listing an RFD for sale on Amazon, you must do one of the following in the FCC Radio Frequency Emissions Compliance Properties:
1) Provide proof of FCC authorization , including the FCC certification number or contact information for the responsible party as defined by the FCC.
2) Declare that the product cannot emit radio frequency energy or does not require an FCC radio frequency device authorization. How do I comply with Amazon's policy on FCC RF emissions compliance attributes? According to Amazon, at the end of February 2021, in order to create a new listing or update an existing RF device listing, you will need to fill out the FCC Radio Frequency Emissions Compliance Attribute. In the properties, you must do one of the following: provide evidence of Federal Communications Commission (FCC) authorization, an FCC certification number or contact information for a responsible party as defined by the FCC; or certify that the product is not subject to FCC requirements.
According to Amazon's policy, all Radio Frequency Devices (RFDs) must comply with Federal Communications Commission (FCC) regulations and all federal, state, and local laws that apply to these products and product listings; sellers have nearly 5 weeks to ensure they Follow the new policy.
